            📄 1. Tenancy Brokerage Agreement (Digital Version)

            ⚠️ Disclaimer: This is an English translation of the Dutch agreement. In the event of any conflict or inconsistency between this translation and the original Dutch version, the Dutch version shall prevail. This translation is provided for convenience only and has no independent legal force.


            Tenancy Brokerage Agreement (Digital)

            IJisberg Real Estate, with its registered office at Postjeskade 36, 1057 DS Amsterdam, listed in the Dutch Chamber of Commerce under number 56259077, hereinafter: “Agent”,
            and
            [Client], hereinafter: “Client”,

            agree as follows:


            Article 1 – Purpose of the agreement

            The Client is looking for residential rental property and hereby engages the Agent to act as intermediary in establishing a lease agreement with a third party (the landlord). The Agent shall exclusively represent the interests of the Client.


            Article 2 – Services of the Agent

            Services may include:

            • Identifying the Client’s preferences and search criteria;

            • Selecting and offering suitable rental properties;

            • Organising and accompanying viewings;

            • Negotiating lease terms with landlords;

            • Verifying and explaining the lease agreement;

            • Supervising check-in and drawing up an inspection report;

            • Advising on utility registration, maintenance and tenancy matters;

            • Acting as first point of contact during the tenancy.

            The Agent does not act as an authorised representative and will not enter into legal acts on behalf of the Client.


            Article 3 – Brokerage fee and payment

            1. The Client owes a brokerage fee once a lease agreement is concluded through the Agent’s mediation.

            2. The brokerage fee amounts to:

              • One month’s gross rent (including service charges)

              • With a minimum of € 2,000 excl. 21% VAT

            3. Payment must be made within 5 days of the invoice date and always before the check-in/key handover. No check-in will take place until full payment has been received.

            4. If no lease agreement is concluded, no fee is owed (“no cure, no pay”).

            5. Upon acceptance of a rental property, the first month’s rent, deposit, and brokerage fee are invoiced.


            Article 4 – Client obligations

            The Client shall provide all required and accurate documentation on time, including:

            • Valid identification;

            • Proof of income (pay slips or annual accounts);

            • Bank statements;

            • Employer’s statement or Chamber of Commerce registration.


            Article 5 – Digital confirmation

            This agreement is legally concluded via digital acceptance. It is valid under Dutch Civil Code Article 6:227a and the EU eIDAS Regulation. IP address, timestamp, and email are logged.


            Article 6 – Applicable terms

            The General Brokerage Terms for Tenants of IJisberg Real Estate apply to this agreement. These are available on our website and are included with the confirmation.


            Final provisions

            This agreement is governed exclusively by Dutch law. Disputes will be submitted to the competent court in Amsterdam.
